Nintendo Shuts Down Fan-Made Game; Meets Its Replacement

Nintendo Shuts Down Fan-Made Game; Meets Its Replacement

Whether Nintendo will continue to send cease and desist notifications to ASMB Games or not though, I think the studio got its point across. More than 500 games have been affected with the takedown request.

Unfortunately, No Mario's Sky was hit with a DMCA notice from Nintendo. And now, following its latest takedown, one developer is taking a jab at the company with a new game, titled DMCA's Sky - and it looks like there is nothing that Nintendo can do about it. GameJolt pulled back more than 500 fan-made games based on Super Mario, Pokémon, and Legend of Zelda in the name of copyright claims. Nintendo has created most of the legal threats of recent time. Nintendo recently learned that content available at https://asmb.itch.io/no-marios-sky infringes copyrights owned by Nintendo. Of course, there's also the rather disheartening story of Nintendo forcing Archive.org to remove the online collection of Nintendo Power magazines that had been assembled on the website. Being unable to go up against the power of Nintendo, ASMB promptly brought the game down.

"Nintendo respects the intellectual property of others, and we ask users of Nintendo products and services to do the same", it states. "Thanks for playing, everyone!"

They also add that they are thankful for everyone who played and enjoyed their short lived game and hopes that an official version will be released by Nintendo. "Made in 72 hours for Ludum Dare 36", the new description for the game reads.

DMCA's Sky does not feature Mario or any Goombas.
