Concert venue owner won't comment on lawsuit

According to reports, lawyers representing 17 of the people injured when a railing collapsed at the duo's "High Road" concert have filed a lawsuit against the venue's owner and the performers, claiming they didn't take enough precautions to ensure safety.

Attorneys from the firm of Saltz, Mongeluzzi, Barrett and Bendesky, along with attorney Steven G. Wigrizer of Wapner Newman, announced Wednesday morning they had filed the lawsuit, stemming from the August 5 incident at BB&T; Pavilion in Camden, New Jersey.

The plaintiffs, represented by Philadelphia attorney Robert J. Mongeluzzi, include 14 fans who were attending the concert and three workers at the BB&T; Pavilion along the Delaware Riverfront. A railing that separated one side of the audience from a roughly 10-foot drop to the ground had snapped, leaving many to fall onto the concrete below.

Authorities have said 42 people were hurt in the collapse, which occurred as the rappers were gesturing to fans to come toward the small stage. "The failure of this railing at the concert venue was caused by a failure in planning and execution".

Attorneys say their clients suffered concussions, broken bones, torn ligaments and tendons, and emotional trauma.

Prior to the collapsing of the railing, Snoop and Wiz yelled, "Everybody in the motherf***ing grass bring your ass done here", which is being cited on the lawsuit as a "call to action" that eventually led to the railing giving out.

"A safe concert is a concert that is properly planned", said Bob Mongeluzzi, of the Saltz, Mongeluzzi, Barrett and Bendesky law firm.

Concertgoer Katie Colbridge describes the chaotic scene minutes before the railing collapsed. Live Nation is also named as a defendant in the lawsuit.

According to a lawyer Jeffrey P. Goodman (of Mongeluzzi's legal team), "Mr. Broadus and Mr. Thomaz incited and inflamed the crowd by yelling for everyone on the lawn to rush toward a flimsy railing, which was all that separated the fans from the unsafe drop off and the poorly placed second stage".

Representatives for the stars and Live Nation have yet to comment on the case. "That's the setup, and that's the failure". Are the musician's, Live Nation or the stage designers to blame?
