Seventh Circuit likely to uphold Wisconsin voter ID law

A federal appeals court is putting a ruling on hold, over the state's voter ID law.

The State of Wisconsin has been granted a stay on a court ruling that would have allowed Wisconsin voters to provide an affidavit instead of photo identification to vote in November.

The appeals court pointed to a 2008 Supreme Court Decision that upheld a voter ID law in Indiana that includes a provision allowing citizens to receive a free voter ID at the Bureau of Motor Vehicles, Indiana's version of the DMV.

A federal judge approved for November a softer version of Texas' voter ID law that courts have said discriminated against minorities and the poor.

On Wednesday, however, a US appeals court issued a stay in the case, allowing the "strict" practices to remain in place.

In Wednesday's ruling, a three-judge panel from the 7th Circuit Court of Appeals concluded that the trial court's decision would likely be reversed on appeal.

A spokesman for the state elections commission, Reid Magney, said the decision means that "no affidavit option is in effect for future elections" for those who say they can not obtain voter IDs.

The ruling also struck down a host of other Republican-backed laws limiting days and locations for early voting, saying they discriminated against minorities.

The Seventh Circuit has issued a stay against a voter ID decision, ruling that the district court failed to identify any substantive burdens placed on voters. He took issue with the process Wisconsin created to let those without an ID obtain a temporary receipt that lets them vote while they apply for the card.

Frank v. Walker was argued in the U.S. District Court for the Eastern District of Wisconsin. It was in effect for the April presidential primary and Tuesday's general election primary. The state has also filed an appeal challenging that ruling. "Voters in Wisconsin support voter ID, and our administration will continue to work to make it easy to vote and hard to cheat".

Adelman's ruling was one of two federal judges issued ordering the state to make accommodations for those who have trouble obtaining a required ID.

Under Wisconsin law, if a person does not have a valid ID, they can obtain one for free at the state Department of Motor Vehicles.
